Complaints must be sent by email within 10 days from the end of the actual use of the purchased services.
PAYMENT METHODS:
The prices of the services indicated are always to be considered inclusive of VAT.
Payment is always made online, through the website www.tourinvespa.com (exclusively owned by The Italian Experience Srl), following the appropriate procedure. Several channels are available to make payment: bank transfer (using the details indicated on the site during booking), through the PayPal application, which also works with credit cards, and through the Satispay app.
All payments related to the booking of the indicated services are valid as a confirmation deposit and therefore do not entitle you to any refund in case of cancellation by the customer, unless such cancellation occurs in the manner and within the timeframe indicated in the following paragraph “Withdrawal and cancellation of services”.
WITHDRAWAL AND CANCELLATION OF SERVICES:
If weather conditions (rain, strong wind, ice, etc.), as determined by Tour in Vespa, do not allow the tour to take place, the Customer will be refunded the entire amount paid within 15 working days. Alternatively, they may use a voucher of equal value to be used within 1 year from the date of the purchased tour.
The Customer has the option to cancel activities, but must communicate this one month in advance of the established date: in this case the cancellation is free. With 15 days’ notice, they can obtain a 50% refund. After this period the tour is to be considered confirmed. It can only be canceled if the conditions specified in the previous paragraph occur (see weather conditions).
If the Customer starts the tour despite uncertain weather conditions, they implicitly accept the risk and will not be refunded in any case. Even if bad weather occurs after the activity has started. If Tour in Vespa cancels the activity, the Customer is entitled to a full refund of the services previously paid for. The Customer is required to communicate any delays for picking up the Vespa, by contacting the telephone numbers indicated during booking. If the Customer does not communicate the delay and arrives at the vehicle pickup point more than 1 hour late, Tour in Vespa is authorized to no longer provide the requested services and not to refund the amount paid. If the Customer is not deemed suitable to drive, at the sole discretion of the person delivering the vehicle, the tour is considered canceled and no refund is possible.
In case of activity cancellation, ancillary services (accommodation, lunch or tasting) are non-refundable.
DEFINITION OF TOURIST PACKAGE:
The special regime for travel agencies/tour operators applies to services related to the organization of “tour packages” consisting of all-inclusive trips, vacations and tours (art. 2 of Legislative Decree 111/95). The aforementioned “tour packages” must (art. 1 paragraph 1 of Ministerial Decree 340/99):
be composed of at least two of the following elements:
– transport;
– accommodation;
– tourist services not ancillary to transport or accommodation, constituting a significant part of the “tour package” (e.g. itineraries and visits, with or without guides).
DAMAGES, TECHNICAL FAILURES AND VEHICLE OPERATION:
In case of vehicle breakdown, Tour in Vespa undertakes to provide assistance within 1 hour of the breakdown being reported. To report, use the contacts at the bottom of this site. The Customer who, through their negligence, damages the vehicle is liable for full compensation for the damage and hereby authorizes Tour in Vespa to charge the amount to the credit card provided when picking up the vehicle. No amount is charged from the credit card requested when picking up. This only happens if the conditions previously described occur (see breakdown/damage caused by the Customer).
Before handing over the vehicle (Vespa or Calessino or other unspecified), the tour managers subject the Customer to a test to verify if they are actually able to drive the vehicle. If the Customer is not deemed suitable to drive, at the sole discretion of the person delivering the vehicle, the tour is considered canceled and no refund is possible. We therefore invite Customers to specify at the time of booking any gaps regarding the operation of the aforementioned vehicles.
The Electric Vespa and the Ape Calessino have third-party liability insurance coverage that covers damages caused by third parties and to the passenger. The petrol Vespas, on the other hand, are covered by “mini-kasko” with a deductible of 500 euros.
At the time of vehicle delivery, before signing the contract, customers are asked for the details of a valid credit card, as a guarantee for the vehicle they are renting. In case of lack of a valid credit card, 300 euros in cash must be handed over which will be duly returned at the end of the activity.
INSURANCE AND GUARANTEE FUND:
During their tourist experience, Customers are covered by our Civil Liability Insurance (Tua Assicurazioni, policy No. 40324512001433). “Con le Ali sotto i piedi” is a travel agency/tour operator registered with the Guarantee Fund of Tua Assicurazioni, with headquarters at Largo Tazio Nuvolari 1 in Milan, with policy No. 40324512000456.
LEGAL DISPUTES:
For any disputes, the competent court is the Court of Turin.
